Commissioner Spicer, Commissioner Mayo, and Commissioner Thurlow were present at a regular meeting beginning at 8:30 a.m. The minutes were approved as printed.

The Board approved the annual Kansas Association of Counties dues for 2010 in the amount of $1,923.19.

Jami Williams, Economic Development Director, and Peter Armesto, State of Kansas Energy Office met with the Board. Mr. Armesto gave a presentation on Facility Conservation Improvement Program. This is a program is administered by the KCC’s Energy Programs Division and facilitates the implementation and financing of energy conservation improvements in state, municipal , county and educational facilities. This is done by connection local units of government and school districts with pre-approved, -private energy service companies (ESCOs) that evaluate the facility, identify energy-saving opportunities, and recommended a turn-key package of upgrades to be financed through the projected utility bill savings. Commissioner Mayo made the motion to proceed with this project and have a Preliminary Energy Audit at no cost. Commissioner Thurlow seconded and the motion passes unanimously. Ms. Williams presented the cost of the advertising for the Economic Development Expansion Solution Magazine Website. Commissioner Mayo made the motion to pay advertising at a cost of $1,000 out of the Economic Development Fund. Commissioner Thurlow seconded and the motion passed unanimously.

Gary May, County Sanitarian, met with the Board. Mr. May reported that there were four new permits in the County. Three new constructions and one repair.

Gailen Tyrell and Debbie Charest, Landfill/Noxious Weed Director, met with the Board. The bids were opened on the 4-wheelers as follows:
Bruna Implement Company: 2010 Polaris Ranger 800 XP – that meets or exceeds Bid Specifications. 4500 Pound winch, 72” Plow with mount and frame, and poly Cab with Glass windshield, roof and rear panel -$12,995.00.
Bruna Implement Company: 2010 Polaris Ranger 500 H.O. – that meets or exceeds bid specifications. - $8,549.00
KanEquip, Inc. –Artic Cat XTZ1000 Prowler- does not meet bid specifications - $13,685.42
KanEquip, Inc. – Artic Cat 650TBX- does not meet bid specifications - $7,612.66
After reviewing the bids, Mr. Tyrell made the recommendation to purchase both from Bruna Implement. Commissioner Mayo made the motion to purchase the 2010 Polaris Ranger 800XP and the 2010 Polaris Ranger 500 H.O. from Bruna Implement Co. at a total cost of $21,844.00 to be paid out of the Weed Capital Outlay Fund. The following transfers to be made for the end of year.
Transfer $48,590 from Solid Waste to Closure/Post Closure Fund.
Transfer $25,000 from Solid Waste to Equipment Capital Outlay Fund.
Transfer $25,000 from Solid Waste to Solid Waste Improvement Fund
Transfer $12,000 from Noxious Weed to Equipment Capital Outlay Fund.
Permission was granted for Mr. Tyrell to maintain his certification with the Department of Ag until the transition of the new Landfill Director is completed. The need to replace the flooring in the office at the Landfill was discussed. The Board told Mr. Tyrell to look in to different kinds of flooring and to report back next week.

Chuck Dunn, Sheriff, met with the Board to give his weekly report. Sheriff Dunn reported that he has filled the Dispatcher position with a current jailer and now he will have a Jailer position to fill.

Steve Liby, Highway Administrator, met with the Board. The proposal for project 14C-4131 was received from Schwab-Eaton, PA. Permission was granted to send this proposal to the State for approval. Township roads and the cost of the maintenance were discussed. Mr. Liby reported that 27,000 tons of rock was placed on township roads in 2009. The average cost was $8.91per ton for rock.

The Board of Commissioners signed a Memorandum of Understanding between Riley C. Rankin and The Clay County Commission regarding the Indian Artifact Collection that is on long term loan for display on the first floor of the Clay County Courthouse.

The Board reviewed and approved Refund/Abatement 09RA05-06 in the amount of $40.34

Clay County will be closed on December 24th and the 25th for observance of Christmas.

The Board adjourned at 12:05 p.m.
